deleted first. Is that the case? Typically a hdd will only overwrite 'free' space. If it's important, low likelihood is still worth trying.

When you delete something it only deletes the index and releases delegation of the sectors assigned to it. If there is a record in the restore images, then it will have the indexes and reassign them to the sectors. If this isn't timely the sectors will be overwritten naturally, and even if the restore has the saved state it may not function if sectors containing the data had been reassigned.
