Likely would need to prove the 4 elements of negligence: (1) DUTY- Bancor Foundation has a duty to exercise reasonable care (2) BREACH - Bancor Network breached that duty by failing to exercise reasonable care that should have been foreseeable (3) DAMAGES - this one is the easiest to prove and (4) CAUSATION - that it was the breach that caused the damages. I think because the Foundation raised ICO money and allocated funds towards marketing 100% IL protection, it would have a duty of reasonable care to whom that marketing was directed. Breach would likely be the hardest to prove. They were warned multiple times that this could happen, but it seemed like they always dismissed it as something that was overblown. They called it the oldest FUD in the book. Would likely need to collect a lot of evidence that the risk was foreseeable and that the precautions that they took were insufficient in light of the potential damages.
