A USDT may be pegged to a USD, but it is not a USD in a legal, technical or practical sense. If it were, it would be covered by finance law. It's not, it's still unregulated.

Practically the same (i.e. in application) but not technically. The reason the peg oscillates is the "technical". It is not technically the same
