We need to differentiate RSR from the protocol as a whole. I don’t think there’s any concern about the protocol itself. As to RSR, were assuming that RSR would be considered an investment contract under the Howey Test at mainnet launch, which I think we have strong arguments to counter. Could the SEC make an argument like the one you propose, certainly. However, we’ve done nothing to create a market for RSR in the US, and we don’t intend to. Even internationally, we don’t pay or even apply for listings on exchanges. We want the exchanges to do it themselves organically
This seems like a very risky strategy. I understand the protocol is separate from the token. But it very much sounds like RSR could be deemed as a security by the SEC. I wonder if you could go back and do things again if you'd do things differently. The protocol will be fine so long as it's decentralized from the beginning. If the team members have control over the protocol in the beginning then there's risk regulators could shut it down. There is also personal liability risk but that's unrelated to the protocol itself.
You're providing "concerns" which I agree with. Unfortunately, I think there's not much any altcoin project with such a token distribution can do. Bitcoin excluded, every other crypto will have to deal with this threat, one day.
