Yep, some smart contracts (like RSR) are never upgradable. That's the scary, but also cool part.

Another cool example: Tornado Cash recently decided to apply a blacklist of OFAC sanctions (basically, anyone blacklisted on OFAC was not allowed to use their solution anymore). However, their smart contract is non-upgradable. So the only thing they could do was add restrictions on the dApp level. Anyone can still interact with the smart contract directly or create a new dApp to do so and go around these new sanctions.
