yea that is true.. hm. Well that is then too bad for the 2nd person (victim). If the person has access to a bank account (mobile phone? or random reader, etc.), then this scammer can buy anything on any webshop. The victim should contact his/her bank.

You will be the victim that is worse off. It works like this. Scammer fake sells something somewhere, he gets a buyer, victim 1. He comes to you buys BCH for the same amount. Victim1 pays You/victim2, you give the scammer your BCH. Victim1 sues you/ victim2 because it never got the item, but has your bank account and thinks you are the scammer.

This shouldn't work in the EU on a P2P exchange, because the other side of the trade doesn't know your Name and Surname. I don't think a SEPA/National bank transfer can be done without giving any name or using an invalid name. The bank should/will just return it if the Name is invalid. This security measure is probably there for this reason. This attack might work against Merloy's exchange, but it won't work against a truly P2P exchange where buyer and seller don't know their names/surnames.
