I haven’t read it, but the phrase “expectations of the investor” looks like the post modern nonsense used in sexual harassment law, where the victim gets to define the crime after the fact. Hopefully the entire document makes it clear “investor” means “reasonable investor”. What about “due diligence” or “caveat emptor”. Administrative agencies should not be able to create law, only Congress. Most administrative agencies should be abolished, with the SEC and BATF near the top of my list. The Supreme Court has been moving recently in the correct direction. Incidentally, were I, God forbid, to be President, I would announce that I would veto any bill that Congress passes automatically if it is longer than nine pages (the length of the Bitcoin white paper).
