see how having a webapp build a covenant to broadcast a transaction against later (also costing the trader 2 tx fees [1 to and 1 from covenant]?) is simpler than having a webapp "sign" and broadcast a single cauldron-like transaction. I also don't think the first seen rule is going anywhere, so it's like giving miners power they don't need because nobody else can reorder once seen.

The first seen will remain in place. It's useful for when there's no conflict or when the transaction has no unconfirmed parents and has a sig, In that case conflicts can be considered as double spend attempts.

Anything broadcast relies on first seen at the node level just like it does now, conflict or not, anything other than a mining node changing its own mempool does nothing.
