why would all the other eosio implementations be excluded from this? Just curious. What sets them all apart in the eyes of regulators? The howey test?
i'm pretty sure but not certain that their launches weren't as decentralised as EOS mainnet, WAX is pretty centralised in general, haven't really looked at how the launch was done, always been a lot of discussion around Telos and how many tokens Doug owns lol
I don't see "distribution" on the howey test anywhere. Does the SEC care how it starts or who's got the rug in their hands?

if a 3rd party owns too much of the supply or has too much control over the chain due to distribution of tokens at launch then they'd probably fail the last question i guess
This might bite someone in the ass, but who? Once DEX's are more prolific, and Privacy tokens more trustworthy or reliable, how will any of this be enforced anyways? Delisting won't hurt as much in a few more years with growing liquidity pools all interconnected with swaps everywhere.

I don’t know. Securities laws are very outdated and technology is advancing very quickly. Hopefully the old security laws won’t hurt anyone. They’ve already very much slowed the progress of Kin. If there are regulatory attacks, EOS is much safer than most other cryptocurrencies because it’s so decentralized. EOS will also be able to tell its story very well soon which will help a lot.
I believe wax did the same thing what EOS did with the ERC 20 tokens then converted it to wax main net tokens. I believe they have clarity and they’re just quiet about it because why these huge US companies with there IP are creating NFT in wax because these companies will not take a chance knowing that the coin could be a security.
The distribution is relevant for understanding if a party has “control”. It’s not as simple as 51% control
