All that means is that Dan will not be sued by the ENF in this litigation.

This doesn't prevent Dan from being sued for other matters by the ENF, nor does it prevent Dan from being sued by other individuals who are not the ENF brining forward similar cases. Important caveat: anyone can sue anyone. But suing someone does not mean you have a case

what happens if the client loses? Who's responsible for legal fees then. Often times the plantiff will be liable to pay the other sides legal fees too
