law that supposedly applied to XRP being sold to institutions qualifies as a security, is Ripple going to argue that since the government had not formally declared that that was the case in regards to crypto/XRP until the day where it was defined that there is a statute of limitations sort of thing where they can only go back as far as that ruling date?
Xrp is a commodity so the security laws don’t apply. The stock of Ripple Inc are securities.
I thought the judged ruled that XRP sold to institutions was deemed a security whereas selling to individuals was where it doesn't which is why it is considered up for debate.
By right xrp shouldn't be treated like a security. Its a product created by a company. It should be treated like how iphone being sold. Only future Ripple listing on NYSE should be treated as security, be a listed company and all. I really don't get it how xrp is considered as one. Well it is what it is
