Yes… but they advertised themselves as a bank! I never realized they were taking these risks with our money. If I had, I would have never deposited my coins there!

If they advertised themselves as a bank, that was fraud. Their TOS clearly says they are not a bank. Hopefully that will come out in the court proceedings to bite them badly. I knew that, but made the mistake of depositing there anyway, so that was my mistake that I am dealing with now.
