in fact reading in the Linux man, a lock is put on the file so that it cannot be edited if the file has not been completely loaded into memory, so in the end we were both right. if executable is used to the kernel the open return ETXTBSY pathname refers to a file that is currently being read by the kernel (e.g., for module/firmware loading), and write access was requested.
